Employment Equity obligations can have financial and public-procurement consequences. Accurate reports, documented plans, and supporting evidence help you manage your responsibilities — they do not guarantee compliance.
For breaches of sections 20, 21, 23 or 44(b), Schedule 1 sets a maximum of the greater of R1.5 million or 2% of turnover where there is no previous contravention. The highest repeat-breach tier — four previous contraventions of the same provision within three years — is the greater of R2.7 million or 10% of turnover.
These are statutory ceilings, not automatic fines. The Labour Court determines any fine; other listed breaches have fixed-rand ceilings.
Source: Act 47 of 2013, Schedule 1Section 53 links state-contract offers to EE compliance certification. For designated employers, certificate conditions include applicable sector targets or reasonable grounds for not meeting them, submission of EE reports, and no relevant adverse discrimination finding or minimum-wage award in the preceding 12 months.
Missing a target is not, by itself, an automatic ban from every tender. Check the certificate requirements and the specific tender conditions; private-sector tenders are not all governed by section 53.
Source: Act 4 of 2022, section 12The Department of Employment and Labour’s 2023/24 annual report records 3,152 Employment Equity inspections. Of these, 1,082 (34%) were recorded as compliant.
These are historical EE inspection results, not all labour inspections, a current-year forecast, or a representative measure of every South African employer. They show why inspection-ready records matter — not your organisation’s likelihood of a fine.

It does not issue an EE compliance certificate, guarantee a tender award, or replace professional legal advice. The sources above provide statutory context and historical inspection data; confirm current requirements and any applicable court orders with your adviser.
